Terms & Conditions

SERVICES: By signing this contract, the Member purchases from Reflexions Real Life Fitness Centre, owned and operated by the Greater St. Catharines and Niagara Accommodation Partners.

TERM AND RENEWAL: Subject to the right of the Member to rescind this contract pursuant 4 herein, this contract shall remain in force for the agreed upon term of contract.

RESCISSION: The member may cancel this contract within a five (5) working day period.

RULES AND REGULATIONS AND CANCELLATION: The Member agrees to abide by all rules and regulations of the Operator in effect from time to time. The Operator reserves the right to cancel this contract at any time for actions or behaviour by the Member that the Operator deems to be inappropriate. Such cancellation shall take effect immediately upon the mailing of written notice to such effect to the Member by registered mail.

TRANSFERABILITY: This membership contract is NOT TRANSFERABLE under any circumstances.

FEES AND EXPENSES NON-REFUNDABLE: All fees and monies paid to the Operator are non-refundable.

ACKNOWLEDGEMENT OF RISK: The undersigned acknowledges that injury, death, or impairment of health due to improper exercise and the playing of sports and that such activities should be undertaken only on the consent of a physician following medical examination and advice to the physician of contemplated activities and under conditions determined appropriate by the physician, including, if necessary, having an individual accompany or assist the used.

WAIVER: The Member agrees that the Operator, its Officers, Directors, Agents and Employees, shall not be responsible or liable to the member or the heirs or the estate of the Member and the Member hereby releases the Operator, its Officers, directors, Agents and employees for: Damages arising from personal injuries, impairment of health due to improper exercise or death sustained by the Member or his / her guests arising from or related to his / her use of the Operators facilities from a fitness program prescribed by the Operator, no matter where practiced, or from the Member’s participation in fitness programs run by the Operator, and Any loss, theft or damage to personal property, suffered by the Member or his / her guests whether or not such loss, theft or damage is caused by any act of negligence or omission on the part of the Operator, its Officers, Directors, Employees or agents.

INDEMNIFICATION: The Member agrees to indemnity the Operator, its Directors, Officers, Agents and Employees from and against all claims and demands against the Operator, its Directors, Officers, Agents, and Employees and related costs and expenses of the Operator, its Directors, Officers, Agents and Employees arising as a result of the Members guest use of the Operators Facilities and or arising from a person accompanying or assisting the Member or guest in use of services of the Operator.

ADDITIONAL TERMS AND CONDITIONS: The Operator may impose additional terms and conditions, as reasonably necessary, to accommodate members and guests with physical disabilities and/or require a physician’s consent to their use of the facilities.

PERSONS ASSISTING MEMBER: Where a physician’s consent requires that a member use health club facilities only with the accompaniment or assistance of another person, the Member agrees that the Assistant shall not be permitted to use the facilities of the Operator until such person accompanying or assisting the Member has executed a waiver in favour of the Operator in a form satisfactory to the Operator.

ENGLISH LANGUAGE: The parties hereto agree that this contract, and all related documents and notices, be written in the English language. The Member acknowledges that the information set forth herein is correct and that he/she has read and understands this contract and will accept and abide by the rules and regulations now in effect or as they may be amended from time to time. By signing this contract, the Member acknowledges the receipt of true copy of this contract and the current rules and regulations.
